1. About these terms

These terms of service (“Terms”) govern your use of the website vivenuk.co.uk and the services provided by VivenUK LTD (trading as “Viven”, “we”, “us”, “our”), a company registered in England and Wales.

By using our website or purchasing a report, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. About the service

Viven provides automated property reports that aggregate publicly available data from government and open-data sources. Our reports are designed to help homebuyers and renters make more informed decisions about properties in the United Kingdom.

We also provide a free email newsletter with property tips, market insights, and product updates.

3. Communications

Transactional emails: When you purchase a report, we will send you transactional emails related to your purchase (such as report delivery and payment confirmation). These are necessary to fulfil our contract with you and do not require separate marketing consent.

Marketing emails: If you subscribe to our newsletter, you consent to receiving marketing emails from us including property tips, market insights, and product updates. You can unsubscribe at any time by clicking the unsubscribe link in any newsletter email or by contacting us at hello@vivenuk.com. Unsubscribing from the newsletter does not affect transactional emails related to report purchases.

4. Eligibility

Our services are intended for individuals aged 18 or over who are based in the United Kingdom. By using our services, you confirm that you meet these requirements.

5. Report accuracy and limitations

Viven reports are generated from third-party data sources including, but not limited to, HM Land Registry, the Energy Performance Certificate Register, Police UK, Get Information About Schools (GIAS), the Environment Agency, Ofcom, and other publicly available sources. While we take reasonable care to present this data accurately:

• We cannot guarantee the accuracy, completeness, or timeliness of data provided by third-party sources. We present data as supplied by these sources and are not responsible for errors or omissions in their data.
• Reports are for informational purposes only and do not constitute professional advice of any kind, including but not limited to legal, financial, surveying, or valuation advice.
• Viven reports are not a substitute for a professional property survey, mortgage valuation, conveyancing searches, or independent legal advice.
• Any property price estimates included in reports are based on comparable sales data and publicly available records. They are approximate indicators only and should not be relied upon for mortgage applications, investment decisions, or any financial commitment.
• Data in reports reflects the information available at the time of generation and may not reflect subsequent changes.

Some sections of our reports include AI-generated observations (“Viven Insights”) produced by large language models. These insights are derived from the data in your report and are provided for informational purposes only. They do not constitute professional advice and should not be relied upon as a substitute for independent professional guidance.

You acknowledge that any decisions you make based on information in a Viven report are made at your own risk.

6. Payment and pricing

All payments are processed securely by Stripe. We never see or store your full card details.

Prices for reports are displayed on our website at the time of purchase. We reserve the right to change our pricing at any time, but any price changes will not affect reports you have already purchased.

During early access or promotional periods, reports may be offered at reduced prices or free of charge. We reserve the right to modify or end promotional pricing at any time.

7. Digital content and your cancellation rights

Our reports are digital content that is delivered to you immediately upon purchase.

By completing your purchase, you expressly consent to the immediate delivery of your report and acknowledge that you lose your right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 once the report has been delivered to you.

This will be made clear to you before you complete your purchase.

If you experience a technical issue with your report (such as the report failing to generate or displaying incorrect data due to an error on our part), please contact us at hello@vivenuk.com and we will work to resolve the issue.

8. Intellectual property

All content on our website, including but not limited to the Viven name, logo, branding, website design, report design, report templates, and any original text or analysis, is the property of VivenUK LTD and is protected by copyright and other intellectual property laws.

The data contained within reports is sourced from third-party public data sources and is presented under the terms of the respective open data licences (such as the Open Government Licence). Our compilation, formatting, and presentation of that data is our intellectual property.

You may not copy, reproduce, redistribute, resell, or commercially exploit any part of our website or reports without our prior written consent.

9. Acceptable use

You agree not to:

• Use automated tools, bots, or scripts to scrape, crawl, or bulk-download reports or data from our website
• Redistribute, resell, or make publicly available any Viven reports without our prior written permission
• Attempt to reverse-engineer, decompile, or otherwise interfere with our systems, software, or APIs
• Use the service for any unlawful purpose or in any way that could damage, disable, or impair our website
• Misrepresent your identity or provide false information when using our services

We reserve the right to suspend or terminate access to our services if we reasonably believe you are in breach of these Terms.

10. Limitation of liability

• Our total liability to you in respect of any claim arising out of or in connection with our services shall not exceed the amount you paid for the specific report giving rise to the claim.

11. Disclaimers

Our website and services are provided on an “as is” and “as available” basis. We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components.

We make no representations or warranties regarding the accuracy or completeness of any third-party data used in our reports. Our reports reflect data available from public sources at the time of generation and we accept no responsibility for changes to that data after your report has been delivered.

13. Severability
